By visiting our Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the Site. Please read these Terms of Service carefully before accessing or using our website.
1. ONLINE STORE TERMS & ELIGIBILITY
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or territory of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
2. ACCURACY OF PRICING AND BILLING
All prices displayed on our Site are quoted in Canadian Dollars (CAD) unless explicitly stated otherwise. Taxes: Applicable provincial and federal taxes (GST, HST, QST, and/or PST) will be calculated and added at checkout based on your shipping address. Errors: We reserve the right to correct any pricing errors or inaccuracies on the Site, even after an order has been submitted. If a pricing error affects your order, we will contact you before shipping to cancel or amend the order. Payment: Payments are handled securely through Shopify's platform. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
3. PRODUCTS, SHIPPING, AND DELIVERY Modifications:
We reserve the right to modify or discontinue any product at any time without notice. Fulfillment: As a single-operator business, we make every effort to process and ship orders promptly. However, shipping and delivery windows provided at checkout are estimates only and cannot be guaranteed. Risk of Loss: All physical items purchased from our store are delivered pursuant to a shipment contract with our carrier (e.g., Canada Post). This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
4. REFUNDS, RETURNS, AND CANCELLATIONS
Our refund and exchange policy is governed by our separate Refund Policy which can be viewed here. Due to the custom and handmade nature of our products, all sales are final. We do not accept returns or offer refunds. If your order arrives damaged, please contact us within 7 days of delivery via our Contact Us page and we will arrange for a replacement at no additional cost to you. We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
5. INTELLECTUAL PROPERTY
All content included on this Site—such as text, graphics, logos, images, product descriptions, and digital downloads—is the property of Giggles & Clay or our platform provider, Shopify, and is protected by Canadian and international copyright laws. You may not reproduce, duplicate, copy, or exploit any portion of the Site without our express written permission.

To the maximum extent permitted by law, Giggles & Clay shall not be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of our service or any products procured using the service. Quebec Residents: For consumers residing in Quebec, nothing in this section is intended to exclude or limit liability for our own intentional acts, gross negligence, or legal warranties provided under Quebec's Consumer Protection Act.
